Terms of Service

Provider: Innowebative Solutions (“we”, “us”, “our”). App: Hitch: Bundles & Upsells (“Hitch”, the “App”, the “Service”).

These Terms of Service (“Terms”) govern your access to and use of Hitch when you install it from the Shopify App Store or otherwise use joinhitch.com in connection with the App. By installing or using Hitch, you agree to these Terms. If you do not agree, do not install or use the App.

Who may use Hitch

Hitch is offered to Shopify merchants. You represent that you have authority to bind the store or business that installs Hitch, that you are at least the age of majority where you live, and that your use complies with Shopify’s terms and applicable law.

What Hitch does

Hitch helps you create and display product bundles, frequently-bought-together recommendations, and upsells on your Shopify storefront, including discounts where you configure them, and related analytics in the App. Features available to you depend on the plan you select. Hitch relies on Shopify APIs, your theme setup (including app embeds and blocks where required), and data you grant access to at install.

Your account and Shopify relationship

Your Shopify account remains yours. Hitch is a third-party app that runs under the scopes you approve. Shopify’s terms, billing policies, and App Store requirements also apply. We are not Shopify, and we are not a party to your agreement with Shopify or your relationships with your customers.

Plans, trials, and billing

  • Paid plans are billed through Shopify’s Billing API. Charges appear on your Shopify invoice according to Shopify’s processes.
  • Plan prices, feature limits (including lookback windows and AI enrichment), and free-trial length are described in the App and on joinhitch.com. We may update plans prospectively; material changes will be reflected in the App or on the site.
  • Free trials are limited. After a trial has been used for a shop, we may refuse a second free trial on reinstall (see our Privacy Policy regarding the trial ledger).
  • You can cancel a paid plan from within Hitch or by uninstalling the App, subject to Shopify’s billing rules for the current billing period. Fees already charged are generally non-refundable except where Shopify or applicable law requires otherwise, or where we expressly agree in writing.

Your responsibilities

  • Configure theme embeds, blocks, and discounts correctly so Hitch works as intended on your storefront.
  • Ensure your storefront, pricing, discounts, and marketing comply with law and with Shopify’s policies.
  • Maintain your own customer-facing privacy policy and handle customer rights requests for your store.
  • Keep staff access to Hitch limited to people authorized to manage your store.
  • Do not misuse the Service: no reverse engineering beyond what law allows, no probing or attacking our systems, no using Hitch to violate others’ rights, and no automated abuse beyond normal store operation.

Intellectual property

We and our licensors own Hitch, including software, branding, and documentation. You retain ownership of your store content, catalog, and customer relationships. You grant us a limited license to use store data solely to provide and improve Hitch for your store, as described in our Privacy Policy.

Third-party services

Hitch depends on Shopify and may use subprocessors (for example hosting, database, email delivery, and optional AI enrichment). Those services have their own terms. Outages or changes on Shopify or a subprocessor can affect Hitch; we are not responsible for third-party platforms we do not control.

Privacy

How we collect and process store data is described in our Privacy Policy, which forms part of your agreement with us when you use Hitch.

Disclaimer of warranties

Hitch is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Hitch will be uninterrupted, error-free, or that recommendations or attributed revenue figures will meet your commercial goals. Theme conflicts, incorrect setup, or Shopify API changes may affect results.

Limitation of liability

To the fullest extent permitted by law, Innowebative Solutions and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from your use of Hitch. Our total liability for claims arising out of these Terms or the Service will not exceed the amounts you paid us through Shopify for Hitch in the three (3) months before the claim. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted.

Indemnity

You agree to defend and indemnify us against claims arising from your storefront, your products or pricing, your misuse of Hitch, or your violation of these Terms or applicable law, except to the extent caused by our willful misconduct.

Suspension and termination

You may stop using Hitch at any time by uninstalling it. We may suspend or terminate access if you breach these Terms, if required by Shopify or law, or if we discontinue the Service. On uninstall, we delete store data as described in the Privacy Policy, subject to the limited trial-ledger exception.

Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. Continued use of Hitch after an update constitutes acceptance of the revised Terms. If you do not agree, uninstall the App.
